Tim Bosma homicide: Second suspect Mark Smich appears in court HAMILTON—A second suspect charged in the disappearance and death of Tim Bosma made a brief court appearance this morning sporting several injuries.

Mark Smich, 25, of Oakville, only spoke his name and answered “yes” to several questions during a 10-minute appearance in a Hamilton court before hunching away from some four dozen reporters seated inside.

He covered a black eye and cut on his left cheek with his hand.

Smich is the second person to be charged with first-degree murder in the death of Bosma, 32. Dellen Millard, 27, of Toronto, has also been charged and remains in custody.

“At this point, Mr. Smich has planned to plead not guilty,” his lawyer Thomas Dungey told reporters after Thursday’s court appearance. “We will be defending this case vigorously”

Police allege Smich and Millard arrived at Bosma’s rural Ancaster home on May 6 to test drive his 2007 Doge Ram pickup. Bosma never returned. His truck was found parked inside a trailer belonging to Millard at his mother’s home. His body was found burned “beyond recognition” on Millard’s Waterloo farm.

Police say the two accused know each other, but have not elaborated.

Neighbours on Smich’s Oakville street, near where he was arrested on Wednesday morning, say the man was friendly in passing, often hanging out with friends on his front porch and working on cars in front of his house.

Smich, who stood at medium height with a thin build and wearing a dirty brown t-shirt and baggy jeans, appeared nervous in the courtroom as he looked around for a few seconds and did not appear to recognize anyone in the crowd.

He was remanded into custody and will appear again on June 13. Reported by Toronto Star 2 days ago.

Tim Bosma: Toronto homicide unit execute search warrant at suspect Dellen Millard’s farm Toronto Police homicide investigators are executing a search warrant at the farm where Tim Bosma’s remains were found this month.

Officers were in the process of executing the warrant Tuesday afternoon, Const. Tony Vella said.

It’s not clear what police are looking to find.

The Waterloo farm on Roseville Rd. belongs to 27-year-old Etobicoke man Dellen Millard, who is charged with first-degree murder in the death of Bosma.

Toronto police, who have been working jointly with Hamilton police, are also investigating Millard in connection with missing Toronto woman Laura Babcock, who was last seen in the Queen and Roncesvalles area in June 2012.

Her phone records show Babcock and Millard exchanged eight phone calls in the days leading up to her disappearance. Police did not originally interview Millard in the case. Babcock’s parents say Millard and their daughter were friends.

Police are also investigating the apparent suicide of Millard’s father, Wayne, who died at the Etobicoke home he shared with his son in 2012.

Earlier this month, Bosma went missing after two men arrived at his Ancaster home to test drive his 2007 Dodge Ram. His remains were later found “burned beyond recognition” on the farm.

Millard is co-accused with 25-year-old Oakville man Mark Smich in relation to Bosma’s disappearance and death.

Tim Bosma murder case: Toronto homicide unit suspends search on suspect Dellen Millard’s farm due to bad weather Toronto police are holding off searching the farm where Tim Bosma’s remains were found earlier this month because of Tuesday’s downpour.

Police are investigating two cases related to murder suspect Dellen Millard, 27 — the apparent suicide of his father, Wayne, and the disappearance of 23-year-old Laura Babcock of Toronto.

“We are there, however the search has been postponed because of weather,” said Const. Victor Kwong. “We will continue tomorrow (Thursday) weather permitting.”

Kwong wasn’t sure how much time the warrant has granted police to search the property, but said the search warrant remains open.

On Tuesday afternoon, officers searched the sprawling Ayr farm owned by Millard, who is charged with first-degree murder in the case of Bosma, alongside Mark Smich, 25, of Oakville.

Police refused to comment on what they were seeking but officers on the scene focused on something that may be buried, using sophisticated radar equipment.

Hamilton police cleared the scene last week after a comprehensive ground search in Bosma’s death.

Babcock was last seen in the Queen St. W. and Roncesvalles Ave. area on June 26, 2012. Her phone records show she and Millard exchanged eight phone calls in the days leading up to her disappearance, including her last call on July 3.

Police did not originally interview Millard in the case. Babcock’s parents say Millard and their daughter were friends, but were given few updates on the case in several months.

Laura’s mother, Linda Babcock, said Tuesday they had not heard anything about the search.

“Police haven’t contacted us,” she said. “That’s a good thing, right?”

That search of the property — a mix of wooded areas and hilly grassland — appeared to focus on a small area adjacent to a dilapidated grey barn. Just after 1 p.m., officers placed yellow markers on the grass near piles of dirt that were cleared from a 20-by-20-metre area.

Officers wheeled ground-penetrating radar — a device provided by OPP that can be used to reveal buried objects — over the cleared earth.

A police forensics van was parked on the site before the search was called off just before 5 p.m. as a storm rolled into the region.

Earlier, police removed an incinerator found on the property.

A source told the Toronto Star Bosma was killed in his truck after he took two men for a test drive in his 2007 Dodge Ram pickup. He was later burned, but police have not confirmed the incinerator was used.

Police allege Millard and Smich are the men who climbed into Bosma’s car that night and were tailed by a second vehicle, a Chevrolet Yukon SUV owned by Millard. A third suspect has not been arrested.

Investigators are also re-examining the apparent suicide of Millard’s father who died last November at the Etobicoke home he shared with his son.

At the time, police were called to the home for a death investigation. They later ruled out foul play, but a coroner’s investigation remained open even after the body was cremated. Following Millard’s arrest, Toronto police reopened their investigation.

Millard’s lawyer, Deepak Paradkar, said his client was interviewed by police after his father’s death, but was not interviewed about Babcock.

Paradkar had few details about Tuesday’s search and did not know what evidentiary grounds police used to obtain their warrant.

Tim Bosma: ‘I saw a large amount of blood’ around boat rented by Dellan Millard, owner says Ontario Provincial Police are investigating after a charter yacht operator on Manitoulin Island said he saw blood on a boat used by murder suspect Dellen Millard in 2011.

Al Boyd, media liaison officer for the Manitoulin Island OPP detachment, confirmed police had responded to a complaint phoned in by Chris Blodgett, owner of Discovery Yacht Charters in Little Current, Ont., in relation to a boat.

“As of now, we are not sure what we have. We are looking into a complaint made by the owner,” Boyd said Wednesday. “That's all we can confirm at this time.”

Boyd said the OPP started looking into Blodgett’s complaint on May 14. He could not confirm Wednesday whether a search warrant had been issued.

Blodgett provided police with details about a 10-day boat trip Millard took along Lake Huron’s North Channel, north of Manitoulin Island, in 2011.

Millard, 27, of Etobicoke and 25-year-old Mark Smich of Oakville are charged with first-degree murder in the death of Tim Bosma of Ancaster. Police say Bosma’s charred remains were found on Millard’s 102-acre farm in Ayr, Ont., 10 days after his disappearance on May 6.

Blodgett phoned the OPP after seeing footage of Millard on TV two weeks ago. Millard was first charged on May 11.

“I put in a call after seeing him in the news and when I saw him I was absolutely shocked,” Blodgett said, noting he remembered Millard’s red Mohawk hairstyle.

Millard rented a 32-foot yacht — white hull, with a green stripe. Discovery Yacht has a single 32-foot “Thalia” listed under its fleet, but Blodgett declined to identify the boat.

Blodgett said Millard took two trips, each with a different woman, and it was on the second trip he called for assistance because of a mechanical failure early one morning.

“When I arrived, I saw a large amount of blood around the boat,” he said. “After questioning Millard about it, I was satisfied with his answer and confident nothing unreasonable had taken place on the yacht. You’ll need to speak with OPP on how Millard answered that question.”

Blodgett said the woman Millard had sailed with was not visible during his time repairing the yacht. In the six years Blodgett has worked at Discovery Yacht Charters, he said, he never saw Millard apart from the trips he took in 2011.

Millard’s lawyer, Deepak Paradkar, learned of the OPP investigation concerning his client and a yacht from a reporter Wednesday.

“Haven't heard anything about it and I’m sure my client hasn’t either,” the lawyer said.

Detective Inspector David Hillman at the OPP Criminal Investigations Branch confirmed Wednesday evening the OPP received Blodgett’s report and said they are investigating independently to confirm what took place.

Toronto Police said they are not investigating the report at this point, contradicting earlier comments by the OPP which suggested they were assisting Toronto Police.

They are investigating two cases related to Dellen Millard — the apparent suicide of his father, Wayne, and the June 2012 disappearance of 23-year-old Laura Babcock of Toronto.

The Toronto homicide squad, led by Detective Mike Carbone, began searching Millard’s Ayr farm late Tuesday morning, according to media officer Constable Tony Vella.

Vella would not say what police are looking for or when the search warrant for the farm would expire. Police planned to return to complete their work later in the week after heavy rain on Tuesday afternoon cut their efforts short.

“We are there. However the search has been postponed because of weather,” said Constable Victor Kwong. “We will continue tomorrow (Thursday), weather permitting.”

Tim Bosma murder case: Stolen vehicles recovered from Dellen Millard’s hangar, police say A number of stolen vehicles have been recovered from Dellen Millard’s hangar, Hamilton police have confirmed.

The development came the same day Toronto police completed their search of the murder suspect’s farm, where Tim Bosma’s charred remains were found. Police spent at least two days scouring the property in Ayr, near Waterloo, but refused to discuss details of the search.

One of the vehicles recovered at the Waterloo airport hangar earlier this month is a $35,000 Harley-Davidson belonging to Marty MacDougall. The Toronto resident said he advertised his motorcycle on Kijiji last fall before pulling his ad from the site.

The motorcycle sat inside his trailer when both were stolen from the driveway behind his home on King St. E. shortly after he pulled the ad, he said.

While in Ireland, MacDougall received a text from Hamilton police saying they found his motorcycle, but it was in pieces with the serial numbers scratched off except for one he placed on the seat. That’s how police found MacDougall.

“It’s just a bike,” MacDougall said. “It’s nothing compared to what the Bosmas are going through now. They’ll never get Tim back.

“This is sad, really sad.”

Bosma went missing May 6 after taking two men for a test drive in his Dodge Ram pickup truck. It was the last time his family ever saw him again. Bosma had also advertised his truck for sale online, including Kijiji.

Millard, 27, has been charged with first-degree murder, along with Mark Smich, 25.

Millard’s lawyer, Deepak Paradkar, was surprised to hear police discussing the vehicles.

“I would have thought that if they’re trying to build a case they would have kept everything as evidence,” said Paradkar. “Crown counsel hasn’t told me about any additional charges.”

On Thursday, Toronto police were back at the farm scouring an area behind a dilapidated barn. They dug several giant holes with a backhoe before filling them back in.

Toronto police are also continuing to investigate the disappearance of Laura Babcock, whose final calls were to Millard last July, as well as the apparent suicide of Millard’s father, Wayne, last November.

Hamilton police wouldn’t get into details of the number and nature of the vehicles. They are still trying to find their owners, but said there are fewer than 10.

Meanwhile, MacDougall told the Star he’s sifting through the parts of his bike, which have been returned to him, but doesn’t yet have all of them. Some have been painted, he said, while others appear in good condition.
